Culpa in contraltendo, meaning 'the fault in contracting' in verbatim translation,the contractual duty of good faith to the negotiations phase, and reveals a 'pre-contractual duty of good faith'. The culpa in contrahendo is yet to reach a general acceptance among the Civil law legal systems, where it emerged from, let alone reaching the universal acceptance that the contractual duty of good faith enjoys, it stili provokes heated discussions.
